Terms of Service

1. Eligibility

You must be 13 years or older to use StudyBuddy. If you are under 18, you must have permission from a parent or legal guardian to use the App.

Parental Responsibility: If you are under 18, your parent or legal guardian agrees to these Terms on your behalf and is responsible for your use of the App, including any purchases made through your account. By allowing a minor to use StudyBuddy, the parent or legal guardian accepts these Terms and agrees to be bound by them.

Purchases: To purchase a premium subscription, you must be 18 years of age or older, or have the express permission and supervision of a parent or legal guardian who agrees to be responsible for the transaction.

2. Your Account

To use StudyBuddy, you must create an account using a valid email address. You agree to:

• Provide accurate information
• Keep your login credentials secure
• Not share your account with others
• Notify us if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

• Use StudyBuddy for illegal activities
• Attempt to hack, reverse engineer, or disrupt the App
• Upload harmful or malicious content
• Harass, threaten, or abuse others
• Use AI features to generate harmful or inappropriate content
• Attempt to access data belonging to other users

Violation of these rules may result in account termination.

4. Payments, Subscriptions, and Refunds

StudyBuddy offers premium features through paid subscriptions ("StudyBuddy Premium"). By selecting a subscription, you agree to pay the stated monthly or annual fees.

• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled at least 24 hours before the renewal date.
• Cancellations: You may cancel at any time via your account settings (or through Apple/Google if purchased via the App Store/Play Store). Cancellations take effect at the end of the current billing period.
• Refunds: All purchases are final and non-refundable. We do not provide prorated refunds for partially used billing periods.
• Payment Processing: Payments are handled by secure third-party processors (Stripe, Apple, or Google). StudyBuddy does not collect or store your full credit card information.

5. AI-Generated Content

StudyBuddy uses Google Gemini to generate notes, flashcards, quizzes, study plans, and chat responses. You understand and agree that:

• AI may generate incorrect or incomplete information
• AI content should be reviewed before use
• AI is not a substitute for professional tutoring
• You are responsible for how you use AI-generated content

Disclaimer: StudyBuddy's AI features are provided for educational assistance only. We make no warranties about the accuracy, completeness, or reliability of AI-generated content. We are not responsible for your grades, exam results, academic standing, or any decisions you make based on AI-generated content. AI features should not be used for medical, psychological, legal, or financial advice. To the fullest extent permitted by applicable law, we disclaim all liability for damages arising from your use of or reliance on AI-generated content.

6. User-Generated Content

You may create or upload notes, flashcards, tasks, calendar events, AI prompts, and files. You retain full ownership of your content. You grant StudyBuddy a non-exclusive, revocable, royalty-free license to store, display, and process your content solely to provide app functionality to you. We do not use your content for marketing, training AI models, or any purpose other than delivering the service. When you delete content or your account, the license terminates and your content is permanently deleted.

7. Data Collection & Privacy

Your use of StudyBuddy is also governed by our Privacy Policy.

8. Account Deletion

You may delete your account at any time using the in-app "Delete Account" button. Deletion requires typing DELETE to confirm. When you delete your account, your personal data, study data, AI content, and uploaded files are permanently removed. Anonymized analytics may be retained.

9. Intellectual Property

All StudyBuddy branding, design, original code, and features are owned by us. You may not copy, modify, distribute, sell, or reverse engineer any part of the App. StudyBuddy may include open-source software components subject to their respective licenses; our intellectual property claim applies to StudyBuddy's original code, design, branding, and content only.

10. Service Availability

We aim to keep StudyBuddy available at all times, but we do not guarantee uninterrupted service, error-free operation, or perfect performance. We may update, modify, or discontinue features at any time.

11. Limitation of Liability

To the fullest extent permitted by law:

• StudyBuddy is provided "as is"
• We are not liable for damages arising from your use of the App
• We are not responsible for inaccuracies in AI-generated content
• We are not responsible for data loss caused by user actions

Your use of the App is at your own risk.

12. Termination

We may suspend or terminate your account if you violate these Terms, misuse the App, or attempt to harm the service or other users.

13. Changes to These Terms

We may update these Terms from time to time. We will notify users of significant changes. If we make material changes, we will ask you to re-accept the updated Terms. Continued use of the App after changes means you accept the updated Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms or your use of StudyBuddy shall be resolved in the courts of the Province of Ontario, and you consent to the exclusive jurisdiction of those courts.

Before initiating any legal proceeding, you agree to first contact us at support@urstudybuddy.com and attempt to resolve the dispute informally for at least 30 days.
